Knowledge of the law
Many mediators are not lawyers. Some are therapists. Some are finance people. Some of them are very good, depending upon the issues you are struggling with.
However, you may or may not have serious emotional and financial issues. In contrast, you do have significant legal issues to deal with. After all, divorce is a legal process.
Some very good non-attorney mediators make it their business to learn the law. If you want a non-attorney mediator, I can refer you to one that I think is skilled.
However, keep in mind that mediators are not therapists. Further, if you have complex finances, you should probably consult your own financial planner, or accountant.
As a mediator and a divorce lawyer, I know what should be covered in mediation because I know what a judge expects in court. Furthermore, when I write up the agreement reached in mediation – called a memorandum of understanding (an “MOU”) – I’m doing so with a detailed understanding of how it will ultimately be used in a marital settlement agreement (JPA) or joint parenting agreement (JPA).
Skill as mediator
As a divorce lawyer in Chicago and its suburbs, my knowledge of the law and what actually happens in court informs the disputes I mediate. I have met some very skilled mediators who are not lawyers. For example, a finance expert and an psychologist with years of experience. Maybe those type of people are right for you. However, in my opinion, it’s best to look for a divorce mediator who is also a lawyer; after all, you are mediating a legal dispute.
As a divorce mediator, I’d like to see my clients as little as possible. Not that I don’t like them, but because the less I see of my clients, the better I’m doing as a divorce mediator.
